David Dimmitt successfully defends against Plaintiff’s motion to remand case back to state court in Perrin v. Dillard’s, Inc. in a case where the Plaintiff alleges she slipped in vomit at Dillard’s store in St. Clair Square in 2013. The District Court agreed with Dillard’s that the Plaintiff deliberately failed to disclose an amount in controversy in excess of the $75,000 requirement for federal diversity jurisdiction. A Madison County, Illinois jury awarded $925,000 to a minor and his parents in a case tried by Richard C. Witzel and David A. Dimmitt. The boy, 14 at the time, struck a steel beam projecting over a sidewalk, causing substantial facial injuries. The Madison County Record, January 16, 2014
